Himson Issues Public Notice on Patent Protection in India

Himson Engineering Private Limited has issued a public notice cautioning against unauthorised use of patented false-twist texturing technology in India, for which it holds exclusive licensing rights.
The notice relates to technology owned by Oerlikon Textile GmbH & Co. KG, headquartered in Remscheid, Germany. Oerlikon, together with its subsidiaries, assignees and group companies (collectively referred to as “OERLIKON”), operates across aerospace, automotive, energy, medical, luxury, semiconductor, tooling and general industry, and is a global leader in manmade fibre spinning systems and texturizing machines.
According to the notice, OERLIKON is the registered proprietor of Indian Patent No. 316763, titled “A False-Twist Texturing Machine For The Texturing Of A Plurality Of Multifilament Threads”, which remains valid and subsisting.
Himson Engineering Private Limited, the flagship company of the Himson Bhogibhai Group, has been granted a sole licence by OERLIKON to use, manufacture, market and commercialise the patented technology within India. Based in Surat, Gujarat, Himson is among India’s largest textile machinery manufacturers, with over five decades of industry experience and a strong global footprint.
The public notice states that any individual, firm or entity that manufactures, sells, offers for sale, imports or otherwise deals in products or processes falling within the scope of the patented technology without authorisation will be deemed to be infringing OERLIKON’s patent rights. Such actions would constitute infringement under the Patents Act, 1970, and may attract legal consequences including injunctions, damages and recovery of loss of profits.
The notice further cautions industry participants against engaging in any activity that may amount to patent infringement and confirms that HIMSON and OERLIKON, either jointly or individually, reserve the right to initiate appropriate legal action against infringing parties or those assisting in infringement.
